1. Introduction

1.1 Welcome

Welcome to Amaanah (“Platform”, “Service”, “we”, “us”, or “our”), an Islamic marriage matchmaking platform designed to facilitate introductions between Muslims seeking marriage in accordance with their personal values, preferences, and conditions.

1.2 Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of:

• our website;
• software;
• services;
• communications;
• matchmaking systems;
• AI-powered compatibility systems; and
• all related products and services.

By creating an account, accessing, or using the Service in any manner, you confirm that:

• you have read these Terms;
• you understand them; and
• you agree to be legally bound by them.

If you do not agree to these Terms, you must not use the Service.

2. Important Disclaimers

2.1 No Guarantee of Matches

The Platform provides access to an Islamic matchmaking service only.

We do NOT guarantee:

• any match;
• any number of matches;
• weekly matches;
• compatibility;
• responses from other users;
• successful introductions;
• engagement;
• marriage;
• religious compatibility;
• emotional compatibility;
• personal satisfaction; or
• any specific outcome whatsoever.

A match round may end without any proposal for you, for example because no candidate meets your requirements, or because you do not meet the requirements of other participants. An empty round is a normal outcome of the Service and does not constitute a defect, a service failure, or grounds for refund.

A subscription grants access to the Platform and its features only.

No refunds shall be issued due to:

• absence of matches;
• rejection by another user;
• incompatibility;
• user inactivity;
• personal dissatisfaction; or
• failure to achieve marriage.

2.2 AI Matching Disclaimer

Matches may be generated or assisted through automated systems, algorithms, artificial intelligence, filtering systems, or compatibility technologies based on information provided by users.

You acknowledge and agree that:

• AI systems may produce inaccurate or incomplete results;
• matches are generated automatically;
• compatibility assessments are subjective;
• algorithms may fail to identify suitable candidates;
• automated systems are inherently imperfect.

We make no warranties regarding:

• accuracy;
• suitability;
• compatibility;
• reliability; or
• success of any match.

2.3 Religious Disclaimer

The Platform is intended solely as a facilitation tool for Muslims seeking marriage.

We do not:

• provide fatwas;
• provide Islamic legal rulings;
• provide religious advice;
• certify Sharia compliance;
• validate religious legitimacy;
• guarantee Islamic compatibility.

Users remain solely responsible for:

• their religious decisions;
• marriage decisions;
• Islamic due diligence;
• consultation with scholars or family members.

3. Eligibility

To use the Service, you must:

• be at least 18 years old;
• have legal capacity to enter binding agreements;
• not be prohibited from using the Service under applicable law;
• not previously have been permanently banned from the Platform;
• provide truthful and accurate information.

By using the Service, you represent and warrant that all information provided by you is accurate and complete.

4. Female Users and Wali Requirement

4.1 Wali Requirement

Female users may only register and use the Platform if they provide details of a wali where required by the Platform.

The wali may be subject to verification procedures determined solely by us.

4.2 User Responsibility

You are solely responsible for ensuring:

• the accuracy of wali information;
• the legitimacy of the wali;
• compliance with your religious or cultural requirements.

We do not independently verify:

• familial relationships;
• Islamic legitimacy;
• legal authority;
• religious qualifications of any wali.

4.3 Refusal or Removal

We reserve the right to:

• refuse registration;
• suspend accounts;
• deny access;
• remove users

where wali requirements are incomplete, unverifiable, misleading, or violated.

5. Nature of the Service

5.1 Limited Matchmaking System

The Platform operates as a structured matchmaking service.

Users do not freely browse unlimited profiles.

Matches may be provided periodically, including but not limited to:

• weekly matches;
• limited curated introductions;
• compatibility-based suggestions.

5.2 No Obligation to Provide Matches

We are under no obligation to provide:

• a minimum number of matches;
• recurring matches;
• continuous introductions;
• ongoing user availability.

The absence of matches does not constitute:

• service failure;
• breach of contract;
• grounds for refund.

6. No Photos Policy

The Platform may operate without profile photos or visual identity features.

Users acknowledge and agree that:

• profiles may be text-based only;
• decisions may be made without visual information;
• compatibility is not based on physical appearance.

We make no representations regarding:

• appearance;
• identity;
• attractiveness;
• physical characteristics.

7. Account Registration

You agree to:

• provide accurate information;
• maintain updated information;
• maintain confidentiality of your account;
• accept responsibility for all activity under your account.

You may not:

• impersonate another person;
• create fake accounts;
• create accounts for others;
• transfer accounts;
• sell accounts.

We reserve the right to:

• verify identities;
• request documentation;
• suspend unverifiable accounts.

8. Subscriptions and Payments

8.1 Paid Subscription Service

Participation in match rounds requires an active membership. We may offer recurring plans (such as monthly and multi-month bundles), a one-time "Unlimited" plan, free trial periods, and gift cards. Fees, billing cycles, and pricing are displayed before purchase.

8.2 Billing

Payments made on our website are processed by our payment provider (currently Stripe). We never receive or store your full card details.

8.3 Automatic Renewal, Cancellation and Pausing

Recurring subscriptions renew automatically unless cancelled before renewal.

You can cancel a web subscription at any time from your dashboard. Cancellation takes effect at the end of the period you already paid for; until that moment you keep full access, including participation in match rounds.

You may also pause your membership. While paused you do not enter match rounds and recurring billing is stopped until you resume.

8.4 Refunds

To the maximum extent permitted by applicable law:

ALL PAYMENTS ARE NON-REFUNDABLE.

This includes situations where:

• no matches are received;
• matches are rejected;
• users are inactive;
• expectations are unmet;
• compatibility is unsuccessful;
• an account is terminated for a breach of these Terms.

Nothing in these Terms limits any non-waivable statutory rights you have as a consumer. If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal for online purchases. By purchasing, you expressly request immediate performance of the Service and acknowledge that you lose the right of withdrawal once the Service has been fully performed, and that, where performance has begun with your prior express consent, any refund may be limited to the part of the Service not yet delivered, to the extent permitted by law.

8.5 Free Trials and Gift Cards

Free trial periods, where offered, are available once per person, for new members only, and convert into a paid subscription unless cancelled before the trial ends. Gift cards are single-use, cannot be exchanged for cash, and cannot be combined with other offers unless stated otherwise.

8.6 Price Changes

We reserve the right to modify pricing at any time. Price changes apply prospectively only and never to a period you have already paid for.

9. Match Acceptance Process

Where a match is proposed:

• both users must independently accept the match;
• either user may decline without explanation;
• no guarantee exists that either user will proceed.

If both users accept:

• limited communication functionality may be enabled.

10. Limited Communication System

10.1 Message Limits

Users may be limited to a fixed number of messages.

10.2 Moderation and Monitoring

ALL MESSAGES MAY BE:

• reviewed;
• moderated;
• filtered;
• delayed;
• blocked;
• removed.

By using the Service, you expressly consent to such monitoring and moderation.

10.3 Prohibited Information

Users may not share:

• phone numbers;
• email addresses;
• social media accounts;
• external contact details;
• payment information;
• personal addresses;
• encrypted contact methods.

Attempts to circumvent moderation may result in immediate termination.

10.4 Release of Wali Information

Following successful completion of the communication stage, we may provide wali contact details solely at our discretion.

We are not responsible for:

• subsequent communications;
• meetings;
• interactions;
• disputes;
• marriage outcomes.

11. User Conduct

You agree NOT to:

• provide false information;
• harass users;
• abuse users;
• threaten users;
• discriminate against users;
• send spam;
• bypass moderation;
• share explicit content;
• promote unlawful conduct;
• upload malware;
• reverse engineer the Platform;
• scrape data;
• copy profiles;
• manipulate matching systems.

12. Content Moderation

We reserve absolute discretion to:

• review content;
• remove content;
• block communications;
• suspend accounts;
• permanently ban users.

We may use:

• automated moderation tools;
• AI moderation systems;
• manual review processes.

We are not obligated to explain moderation decisions.

13. Safety Disclaimer

We do not conduct guaranteed background checks.

We do not verify:

• marital status;
• criminal history;
• religious sincerity;
• identity accuracy;
• honesty of users.

You interact with users entirely at your own risk.

14. Intellectual Property

14.1 Our Content

All intellectual property rights in the Platform remain exclusively owned by us or our licensors.

You may not:

• copy;
• reproduce;
• distribute;
• reverse engineer;
• commercially exploit

any part of the Service without written permission.

14.2 Your Content

You retain ownership of the content you submit to the Platform, such as your profile information, preferences, and messages. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, moderate, and display that content solely for the purpose of operating and providing the Service, including showing it to users you are matched with in accordance with these Terms. This licence ends when your content is deleted from the Platform, except where limited retention is required as described in our Privacy Policy.

You represent and warrant that you own or have the necessary rights to all content you submit, and that it does not infringe the rights of any third party.

15. Termination

We may suspend or terminate your access immediately, without notice, for any reason including:

• violation of these Terms;
• suspicious activity;
• misuse;
• inappropriate conduct;
• moderation evasion;
• unlawful activity.

Termination may occur:

• with or without warning;
• with or without explanation;
• without refund.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• CONTINUOUS AVAILABILITY;
• ACCURACY;
• RELIABILITY.

We do not guarantee uninterrupted or error-free operation.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR:

• indirect damages;
• emotional distress;
• loss of opportunity;
• reputational harm;
• relationship disputes;
• failed marriages;
• religious disputes;
• data loss;
• financial loss.

OUR TOTAL LIABILITY SHALL NEVER EXCEED:

THE GREATER OF:

• the amount paid by you during the preceding 3 months; OR
• €100.

18. Indemnification

You agree to indemnify and hold harmless Amaanah, its owners, directors, employees, contractors, affiliates, and partners from any claims, liabilities, damages, losses, costs, or legal expenses arising from:

• your use of the Service;
• your conduct;
• your violations of these Terms;
• disputes with other users.

19. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using the Platform, you consent to:

• processing of your personal data;
• moderation of communications;
• AI-assisted processing;
• storage and handling of profile information.

20. Changes to the Service

We reserve the right to:

• modify the Platform;
• change features;
• remove features;
• suspend operations;
• discontinue the Service

at any time without liability.

21. Force Majeure

We shall not be liable for delays or failures caused by events beyond our reasonable control, including:

• cyberattacks;
• internet failures;
• natural disasters;
• wars;
• governmental actions;
• infrastructure failures.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of The Netherlands.

Any disputes shall be subject to the exclusive jurisdiction of the courts of The Netherlands.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain fully valid and enforceable.

24. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings.
